CONTEST RULES “PARIS CONTEST”

 

  1. CONTEST RULES

IMPORTANT:

PLEASE READ THESE RULES (THE “RULES”) BEFORE ENTERING THE “PARIS CONTEST” (THE “CONTEST”) PRESENTED AND ORGANIZED BY LXRANDCO, INC. (THE “ORGANIZER”). BY ENTERING THIS CONTEST, ENTRANTS CONFIRM THAT THEY MEET ALL OF THE ELIGIBILITY REQUIREMENTS SET OUT BELOW AND THAT THEY AGREE TO ABIDE BY THESE RULES WITHOUT RESTRICTION AND TO ABIDE BY ALL DECISIONS OF THE ORGANIZER, WHICH ARE FINAL IN ALL RESPECTS IN RELATION TO THE CONTEST. VOID WHERE PROHIBITED BY LAW.

 

  1. CONTEST PERIOD

The Contest begins on November 1st, 2022 at 10:00AM (EST) and ends on December 31st, 2022 at 1:00PM (EST) (the “Contest Period”). The Organizer is the official timekeeper.

 

  1. ELIGIBILITY

The Contest is open to all permanent legal residents of Canada and the 50 U.S. States (excluding territories and possessions) who are 18+ or have reached the age of majority in their Province, Territory or State of residence at the time of entry, provided that the Contest is not open to employees of the Organizer or its advertising and promotional agencies, nor to its agents, affiliates, subsidiaries, associated companies, and their advertising and promotional agencies, nor to members of the immediate family (father, mother, brothers, sisters, and children) and to persons domiciled with any of the above-mentioned excluded persons. Contest void outside of Canada and the U.S.

 

  1. HOW TO PARTICIPATE

To enter the Contest, entrants will have to place an order during the Contest Period. Each $100 CAD/USD spent during the Contest Period equals one entry. Gift card purchases are not eligible. Orders must not be returned, cancelled, or refunded to be eligible.

No Purchase Necessary. To obtain one (1) entry in the Contest draw without the need to pay for a purchase, entrants will need to send an email to info@lxrco.com and request the “Paris Contest form” to be filled and mailed, with postage affixed, to: PARIS CONTEST, 7399 Boulevard Saint Laurent, Montreal, QC, H2R 1W7, CANADA. Mail-in entries must be received by December 31st, 2022 for timely processing and in order to be eligible.

A limit of one (1) entry per person for each $100 CAD spent is permitted. Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise illicit means to enter the Contest, any duplicate entries, or any other methods not authorized by these Rules, for example, but not limited to, creating multiple email accounts, or entering under a pseudonym, all in Organizer’s sole discretion, will be deemed as tampering and may disqualify an entrant from entering, participating and/or winning a Prize. Entries become the property of the Organizer upon submission and will not be acknowledged or returned. Proof of mailing or submission does not constitute proof of delivery or receipt, as the case may be.

Entry is subject to all applicable international, federal, state, and local laws and regulations and is void where prohibited. In certain jurisdictions, local rules and laws may restrict or prohibit the award of certain prizes or impose additional restrictions on participation.

 

  1. PRIZE

By entering the Contest, entrants have a chance to win the following winning package (the “Prize”):

  • A credit of up to $2,000 CAD ($1,500 USD) on round-trip flights for two people (maximum);
  • Two Celine preowned bags (retail value of $995CAD ( $695 USD) each);
  • A $250 CAD ($200 USD) credit to the Monsieur Dior restaurant; and
  • A $50 CAD ($40 USD) credit to the Yves Saint Laurent Museum.

The Prize has a total value of $4 290CAD ($3 170USD).

Flights will be reimbursed by the Organizer upon reception of flight reservations by the winner. Flight reservation to be submitted for reimbursement no later than May 31st, 2023. Reimbursement will be for the true cost of flights, for a maximum amount of $2,000 CAD ($1,500 USD). All other credits will be settled upon reception of receipts.

The Prize will be awarded pursuant to the process described below. The odds of winning the Prize will depend on the number of eligible entries received by the Organizer during the Contest Period. Entries that have in any way been tampered with, forged, or are incomplete, mechanically reproduced, illegible, damaged, irregular, have been submitted by or through fraudulent or illicit means, subvert the entry process, or do not conform to or satisfy any condition of these Rules in any respect (as determined by the Organizer, in its sole discretion) may be disqualified by the Organizer in its sole discretion. A maximum of one prize can be won per entrant.

The Prize cannot be substituted or exchanged for cash. The Prize must be accepted “AS IS”, WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Replacement of Prize is permitted only at the Organizer's sole discretion. If a Prize cannot be awarded in accordance with these Rules, the Organizer reserves the discretionary right to substitute such Prize with a prize of equal or greater value.

 

5.1 Prize Awarding:

The winner of the Contest will be selected by random draw administered by the Organizer. The random draw will be made at 7399 Boulevard Saint Laurent, Montreal, QC, H2R 1W7, CANADA on January 31st, 2023 at or around approximately 3:00 pm EST among all eligible entrants for the Prize.

The winner will be contacted in person, by phone, message text or email according to the information provided in his/her entry form. If a selected winner cannot be contacted within ten (10) minutes of the draw, incorrectly answers the skill-testing question, fails or refuses to sign the Declaration and Release form in compliance with these Rules, declines the Prize or if the Organizer determines (in its sole discretion) that a selected winner does not meet any other of the Contest conditions set out in these Rules, another draw will be held, and another entrant declared the winner. This process will be repeated until an eligible winner is declared. The Prize will be given in person or shipped to the winner (at the winner’s election), free of charge, at the address provided on his/her entry form. The Organizer is not liable for the failure, for any reason whatsoever, of the winner to receive notification or of the Organizer to receive the winner’s response.

To claim the Prize, a winner will be required to (1) sign a Declaration and Release Form which will be provided to the winner onsite or electronically and (2) if the winner is from Canada, correctly answer the mathematical skill-testing question to be included on the Declaration and Release Form. Failure to comply with any of the above conditions will result in disqualification of any winner.

  1. CONFIDENTIALITY

Entrants' personal information is collected by the Organizer solely for the purpose of administering this Contest. Other informational or commercial communications from the Organizer may be received by the entrant if the entrant consents by checking the appropriate box on the entry form. In addition, the entrant consents to the Organizer disclosing his/her personal information to companies that are responsible for providing specific services, such as organizing the Contest, managing the operations of its websites and databases, or other services related to the operation of the Organizer or the Contest. These companies are committed to maintaining the confidentiality of entrants' personal information in accordance with applicable laws. The use of entrants' personal information is strictly limited to the purpose of performing the specific services to be provided by the above companies. They may not distribute, sell, lend or even transmit the personal information collected to anyone else and must maintain the confidentiality of this information, to the extent permitted by law.

 

  1. LIMITATION OF LIABILITY OF THE ORGANIZER

By entering the Contest, entrants release the Organizer and its respective advertising agencies and affiliates, the promotional partners of the Contest, sponsors, as well as the directors, officers, employees, and agents of the above-mentioned persons, from any and all liability for any loss, damage or injury of any kind arising out of or in connection with the Contest, its administration or a Prize. To be declared a winner, those selected to receive a Prize agree to sign and return, prior to receiving the Prize, a Declaration and Release Form to that effect.

In addition, any winner who has claimed a Prize acknowledges that upon receipt of such Prize, the Organizer shall have no further obligation or liability to such winner.

 

  1. USE OF ENTRANTS' PERSONAL INFORMATION

If selected as winner of the Contest, entrants consent to the disclosure, publication or use of their name, place of residence, photograph, likeness, voice or statement, without compensation or notice, for publicity, marketing or informational purposes in any media or format (including the Internet), for an indefinite period of time and without geographic limitation, in connection with this Contest or similar contests in the future, and agree to sign any document related to this undertaking or deemed necessary by the Organizer.

 

  1. GENERAL CONDITIONS

9.1 All issues and questions concerning the construction, validity, interpretation, and enforceability of the Rules or the rights and obligations as between the entrants and the Organizer in connection with the Contest will be governed by and construed in accordance with the laws of the province of including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.

9.2 All costs and expenses other than those expressly mentioned in the description of the Prize will be borne by the winner.

9.3 All entry forms and other materials sent to the Organizer in connection with the Contest become the property of the Organizer upon submission.

9.4 The entry form is subject to verification by the Organizer. Any incomplete, incomprehensible, mutilated, reproduced or late entry form will be void and will not entitle the entrant to participate in the Contest.

9.5 The Organizer reserves the right to disqualify any person or to cancel one or more entries of any person participating in the Contest or attempting to participate in the Contest by a means that is contrary to the Rules or that is unfair to the other entrants (for example: use of automated equipment to participate in this Contest, hacking, number of entries exceeding the permitted limit, etc.). This person may be reported to the appropriate legal authorities.

9.6 Any attempt by an entrant or any other individual to deliberately damage the Contest site, tamper with the entry process or undermine the legitimate operation of the Contest is a violation of criminal and civil laws. Should such an attempt be made, the Organizer reserves the right to seek damages to the fullest extent permitted by applicable law.

9.7 For the purposes of these Rules, the entrant is the person whose contact information appears on the entry form. The Organizer reserves the right to require identification before awarding a Prize.

9.8 If any section of these Rules is declared or held by a court of competent jurisdiction to be illegal, unenforceable, or invalid, then that section shall be deemed invalid, but all other unaffected sections shall be enforced to the fullest extent permitted by law.

9.9 The Organizer reserves the right, at its sole discretion, to cancel, terminate, modify or suspend, in whole or in part, the Contest at any time, including but not limited to, if an event or human intervention occurs that could alter or influence the administration, security, impartiality or conduct of the Contest as contemplated by these Rules.

9.10 The masculine gender is used without discrimination, for conciseness purposes only.
